disclaimer

1. content of the online offer

The author assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are fundamentally excluded, unless there is evidence of wilful intent or gross negligence on the part of the author.
All offers are subject to change and non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without prior notice or to cease publication temporarily or permanently.

2. references and links

In the case of direct or indirect references to external websites (hyperlinks) that lie outside the author's area of responsibility, a liability obligation would only come into force if the author had knowledge of the content and it was technically possible and reasonable for him to prevent use in the case of illegal content.
The author hereby expressly declares that no illegal content was recognisable on the linked pages at the time the links were created. The author has no influence whatsoever on the current and future design, content or authorship of the linked pages. The author therefore expressly distances himself from all contents of all linked pages that were changed after the link was created. This statement applies to all links and references set within the author's own website as well as to third-party entries in guest books, discussion forums, link directories, mailing lists and all other forms of databases set up by the author to whose content external write access is possible. Liability for illegal, incorrect or incomplete content and in particular for damage resulting from the use or non-use of such information lies solely with the provider of the page to which reference is made, and not with the person who merely refers to the respective publication via links.

3. Urheber- und Kennzeichenrecht

The author endeavours to observe the copyrights of the graphics, sound documents, video sequences and texts used in all publications, to use graphics, sound documents, video sequences and texts created by himself or to make use of licence-free graphics, sound documents, video sequences and texts.
All brand names and trademarks mentioned on the website and possibly protected by third parties are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the respective registered owners. The mere mention of a trade mark does not imply that it is not protected by third-party rights!
The copyright for published objects created by the author himself remains solely with the author of the pages. Any duplication or use of objects such as diagrams, sounds or texts in other electronic or printed publications is not permitted without the author's agreement.

4. data protection

If the opportunity for the input of personal or business data (email addresses, name, addresses) is given, the input of these data takes place voluntarily. The use and payment of all offered services is - as far as technically possible and reasonable - also permitted without providing such data or by providing anonymised data or a pseudonym. The use of contact data such as postal addresses, telephone and fax numbers and e-mail addresses published in the imprint or comparable information by third parties for the purpose of sending information that has not been expressly requested is not permitted. We expressly reserve the right to take legal action against the senders of so-called spam mails in the event of violations of this prohibition.

5. Legal validity of this disclaimer

This disclaimer is to be regarded as part of the internet publication which you were referred from. If sections or individual terms of this statement are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact.

1. personal data

1.1 Dr Susanne Fruhstorfer collects, processes and uses your personal data only with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this is done in compliance with data protection and civil law provisions.

1.2 We only collect personal data that is necessary for the performance and processing of our legal services or that you have voluntarily provided to us.

1.3 Personal data is all data that contains individual details about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, national insurance number, video recordings, photos, voice recordings of people and biometric data such as fingerprints. Sensitive data such as health data or data in connection with criminal proceedings may also be included.

2. information and deletion

2.1 As a client or, in general, as a data subject, you have the right to information about your stored personal data, its origin and recipients and the purpose of the data processing as well as a right to rectification, data transfer, objection, restriction of processing and blocking or erasure of incorrect or inadmissibly processed data at any time, subject to compliance with the lawyer's duty of confidentiality.

2.2 If there are any changes to your personal data, please inform us accordingly.

2.3 You have the right to withdraw your consent to the use of your personal data at any time. Your request for information, deletion, correction, objection and/or data transfer, in the latter case, provided that this does not cause a disproportionate effort, can be sent to the address of the law firm stated in point 8 of this declaration.

2.4 If you are of the opinion that the processing of your personal data by us violates the applicable data protection law or your data protection claims have been violated in any other way, you have the option of complaining to the competent supervisory authority. In Austria, the data protection authority is responsible for this.

3. data security

3.1 We protect your personal data by taking appropriate organisational and technical precautions. These precautions relate in particular to protection against unauthorised, unlawful or accidental access, processing, loss, use and manipulation.

3.2 Notwithstanding our endeavours to maintain an appropriately high standard of due diligence at all times, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons.

3.3 Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacking of email account or telephone, interception of faxes).

4. use of the data

4.1 We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. An exception to this is the use for statistical purposes, provided that the data provided has been anonymised.

5. transmission of data to third parties

5.1 In order to fulfil your order, it may also be necessary to forward your data to third parties (e.g. counterparties, substitutes, insurance companies, service providers that we use and to whom we make data available, etc.), courts or authorities.

Your data will only be forwarded on the basis of the GDPR, in particular to fulfil your order or on the basis of your prior consent.

5.2 Furthermore, we inform you that in the context of our legal representation and support, you will also regularly receive factual and case-related information from third parties.

5.3 Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection, for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. disclosure of data breaches

6.1 We endeavour to ensure that data breaches are detected at an early stage and, if necessary, reported immediately to you or the competent supervisory authority, including the respective data categories affected.

7. storage of the data

7.1 We will not store data for longer than is necessary to fulfil our contractual or legal obligations and to defend against any liability claims.

8. Cookies

8.1 This website uses ‘cookies’ to make our website more user-friendly, effective and secure.

8.2 A ‘cookie’ is a small text file that we transmit via our web server to the cookie file of the browser on the hard drive of your computer. This enables our website to recognise you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our website. The content of the cookies we use is limited to an identification number that no longer allows any personal reference to the user. The main purpose of a cookie is to recognise visitors to the website.

8.3 Two types of cookies are used on this website:

8.3.1 Session cookies: These are temporary cookies that remain in your browser's cookie file until you leave our website and are automatically deleted at the end of your visit.

8.3.2 Persistent cookies: For better user-friendliness, cookies remain stored on your end device and allow us to recognise your browser on your next visit.

8.4 You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.

9. web analysis

9.1 Our website uses functions of the web analysis service Google Analytics, a web analysis service of Google Inc. (‘Google’) based in the USA, which uses cookies to analyse the use of the website by its users. The information generated in this way is transferred to the provider's server in the USA and stored there.

9.2 You can prevent this by configuring your browser so that no cookies are stored.

9.3 However, we would like to point out that in this case you may not be able to use all functions of the website to their full extent.

9.4 We have concluded a corresponding contract with the provider for commissioned data processing.

9.5. Ihre IP-Adresse wird erfasst, aber umgehend (z.B. durch Löschung der letzten 8 Bit) pseudonymisiert. Dadurch ist nur mehr eine grobe Lokalisierung möglich.

9.5 Data processing is carried out on the basis of the statutory provisions of Section 96 (3) TKG and Article 6 (1) (a) (consent) and/or (f) (legitimate interest) of the DSGVO.

9.6 Our concern within the meaning of the DSGVO (legitimate interest) is the improvement of our offer and our website. As the privacy of our users is important to us, the user data is pseudonymised.

10. server log files

10.1 In order to optimise this website in terms of system performance, user-friendliness and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your internet protocol address (IP address), browser and language setting, operating system, referrer URL, your internet service provider and date/time.

10.2 This data is not merged with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.

11 Our contact details

11.1 The protection of your data is particularly important to us. You can contact us at any time using the contact details below if you have any questions or wish to withdraw your consent.
